The penalty

In 2019, Ceri Baker came to us as a client asking for help with his PAYE tax. He received a late filing penalty amounting to more than £4000 for late submission during the tax years 2014-15 and 2015-16, arising after we requested for these tax years to be opened on 26th March 2019 and filled them out and submitted them.

Apparently, the reason why there was a penalty to begin with was Baker’s previous accountant had told HMRC that he didn’t meet the minimum requirement needed to submit a return. So, when SixtyFour8 requested for it to be issued, the HMRC representative issued those using the original issue dates, instead of the 26th March 2019.

What we did

To investigate this penalty, the personal accountant on Baker’s case called HMRC on his behalf and asked why this penalty had suddenly cropped up in 2019, and not on the original issue date for those tax years. The response we received was that the date of issuance wasn’t changed by the HMRC agent, resulting in the penalty.

We then appealed for the penalties to be waived and for the payments he made to be returned to him, as this was obviously the result of an error from the tax office representative, and not Mr. Baker himself.

The result?

Mr. Baker received the significant lump sum of more than £4000 returned to him!
